Summary

Relates to requiring social services districts to develop family assessment and services tracks to address cases where there is a prior history of multiple likely malicious and unfounded complaints against the respondent, there is no actual history of founded complaints of abuse or maltreatment against the respondent within the preceding four years, and the initial investigation into the new complaint yields no new information which could indicate the possibility of actual abuse or maltreatment.

Purpose, from the sponsor's memo

Section 1 creates a separate track by which child abuse and maltreatment cases must be investigated if certain conditions are met. These condi- tions include: 1) there is a prior history of multiple likely malicious and unfounded complaints against the respondent, 2) there is no actual history of founded complaints of abuse or maltreatment against the respondent within the preceding four years, and, 3) the initial investigation into the new complaint yields no new infor- mation which could indicate the possibility of actual abuse or maltreat- ment. Section 2 establishes the effective date.

The sponsor's argument

Why Jabari Brisport says this is needed

Under current statute, child protective services across the state have one track to process allegations of abuse or maltreatment. This track requires a thorough investigation and does not allow for a case to be closed sooner than 60 days after it is opened. While this ensures thor- ough investigations, in theory, it is not always an effective use of time or resources. There are countless stories of individuals using false allegations of child abuse or maltreatment to paint one party as unfit and gain an upper hand in an unrelated matter, such as a custody battle, divorce, or interpersonal dispute. All allegations are taken seriously, but exten- uating circumstances require more nuance in certain investigations. In cases where; 1) the respondent has multiple previous unfounded, likely malicious, allegations of abuse or maltreatment against them, 2) there is no actual history of abuse or maltreatment for at least the prior four years, and, 3) the initial investigation into the new complaint indicates a low likelihood that the allegation is legitimate; discretion should be afforded to close the case after due diligence has been given, even if it is earlier than the default 60-day window.

This is the sponsor's own case for the bill, quoted from their memorandum. It is not Agora's description of what the bill does.
