The sponsor's argument

Why Steve Rhoads says this is needed

The New York State Industrial Code, (12 NYCRR Part 23), was adopted on May 30, 1972, setting forth rules, regulations and general safety stand- ards governing demolition, excavation and construction activities within the State with the goal of ensuring uniform workplace safety require- ments. While updated from time to time, there has not been a comprehen- sive review of the provisions of the Code since its initial adoption over 50 years ago. In the interim, there have been significant advances in construction methods and safety protocols, as well as the adoption of other standards promulgated by the Occupational Safety and Health Admin- istration, (OSHA), the American National Standards Institute, (ANSI) and others that have sought to regulate similar activities. It is in the interest of the State and the public to ensure that New York's safety standards reflect the advancement of technology in demoli- tion, excavation and construction methods and advances in equipment and procedures to ensure worksite safety. This legislation would create a temporary State Industrial Code Committee to review the current New York State Industrial Code, as well as OSHA, ANSI and other nationally-recog- nized standards for demolition, excavation and construction activities and worksite safety and issue a report to the Commissioner of Labor and other designated officials by December 1, 2027, recommending revisions, if any, to the Industrial Code. The Committee would contain a cross-sec- tion of representatives from labor, construction, and appointees from relevant government offices to add their knowledge and expertise to the effort.
