Amends the Environmental Conservation Law.

Purpose, from the sponsor's memo

This bill establishes a one-year moratorium on the issuance of Depart- ment of Environmental Conservation (DEC) permits for new data centers. Thereafter, this bill requires a public hearing before issuance of a DEC permit. The bill instructs the Department of Environmental Conservation to complete an environmental impact report charting the current and projected impacts on water, electricity, land use, tax revenue and incentives, and pollution, and other adverse impacts of data center operations in the state. The bill directs the PSC to create a separate and distinct water and electric utility rate class for large data centers to require that these facilities pay their full share of costs to the grid and water infrastructure. The bill establishes renewable energy and energy efficiency goals for data centers, as well as a commu- nity benefits program that will fund community infrastructure and resi- dential home upgrades for host communities of such facilities.

The sponsor's argument

Why Kristen Gonzalez says this is needed

Data Centers consume large amounts of energy and water. Their growing proliferation across the state exacerbates the various issues caused by such intensive resource consumption. These conditions put significant pressure on local communities, infrastructure, utility rates, and the environment. Other jurisdictions in the United States and in Europe have responded by imposing regulatory controls on data center resource use. This legislation aims to protect New York State residents from the nega- tive impacts of large data centers and require that they equitably distribute benefits to local host communities.

This is the sponsor's own case for the bill, quoted from their memorandum. It is not Agora's description of what the bill does.
