Purpose, from the sponsor's memo

Section 1 amends paragraphs a, b, c, and d of subdivision 2-c of section 2808 of the Public Health Law, as it relates to residential healthcare facilities in regard to rates of payment, to establish a schedule, upon which the Department of Health (DOH) would rebase expenses and update Medicaid rates accordingly. It also adds a new paragraph b1 to establish a technical assistance work group with which the DOH would consult. Section 2 provides an effective date.

The sponsor's argument

Why Gustavo Rivera says this is needed

The current rate methodology for nursing homes has not been updated in 15 years. As a result, their rate hasn't changed in 15 years. To set Medicaid rates, DOH does a look-back of expenses in the categories of facilities. Other states that surround New York rebase expense calcu- lations as the basis for Medicaid rates regularly. This bill would ensure that rates keep pace with rising expenses and establish a sched- ule upon which the DOH would be required to rebase expenses and update Medicaid rates accordingly.

This is the sponsor's own case for the bill, quoted from their memorandum. It is not Agora's description of what the bill does.
