Summary from NY Open Legislation. How we handle summaries

Amends the Racing, Pari-Mutuel Wagering and Breeding Law.

Purpose, from the sponsor's memo

Section one amends paragraph (b) of subdivision 1 of section 1352 of the Racing, Pari-Mutuel Wagering and Breeding Law, as added by Section 1 of Part R of Chapter 58 of the Laws of 2023, to require, notwithstanding any other provision of law, that taxes collected from gaming facilities licensed under Title Two-A of Article Thirteen (down- state casinos) be used by the New York State Gaming Commission, before the distributions otherwise required to the Metropolitan Transportation Authority (MTA) Commercial Gaming Revenue Fund and the Commercial Gaming Revenue Fund, to hold harmless certain host counties and host munici- palities. To qualify for the hold harmless, the host county or host municipality must have been appropriated aid in 2025 pursuant to paragraph b of subdivision 3 of section 97-nnnn of the State Finance Law and be located within 100 miles of any gaming facility licensed under Title Two-A of Article Thirteen. The bill provides that such host counties and host municipalities shall not receive less money in any state fiscal year following the commencement of gaming operations by any such Title Two-A facility than they received pursuant to paragraph b of subdivision 3 of section 97-nnnn of the State Finance Law in their highest annual aid in any state fiscal year since the commencement of gaming operations by a gaming facility licensed under Title Two of Article Thirteen. Section one further requires the commission to annually determine the amount necessary to satisfy the hold harmless and to deposit such amount into the Commercial Gaming Revenue Fund for allocation to the eligible host counties and host municipalities for real property tax relief or education assistance. The bill provides that the hold harmless applies as of the first full state fiscal year in which any gaming facility licensed under Title Two-A has commenced gaming operations, requires distance to be measured in a straight line from the premises of the Title Two-A gaming facility to the premises of the Title Two gaming facility, and clarifies that nothing in the bill requires any gaming facility licensee to remit any amount in excess of the taxes, interest and penalties otherwise imposed pursuant to Article Thirteen. Section two provides that the act takes effect immediately.

The sponsor's argument

Why Joseph P. Addabbo Jr. says this is needed

The authorization and licensing of additional downstate commercial gaming facilities is expected to create a significant new source of commercial gaming tax revenue for the State. At the same time, the commencement of gaming operations by those facilities may reduce gaming activity and associated host-community aid for existing commercial gaming facility host counties and host municipalities located near the downstate market. Host counties and host municipalities use commercial gaming host aid for local budgetary purposes, including real property tax relief and educa- tion assistance. A sudden reduction in that aid could create local fiscal disruption for communities that agreed to host commercial gaming facilities and have incorporated that recurring aid into local financial planning. This bill protects eligible host counties and host municipalities by establishing a targeted hold harmless tied to the highest annual aid received under the existing host-aid provision. The bill does not change the tax rate imposed on any casino and does not require any downstate facility or other gaming facility licensee to pay more than the taxes, interest, and penalties otherwise imposed under existing law. Instead, it directs a limited portion of taxes already collected from Title Two-A facilities, before the otherwise applicable distributions, to preserve the eligible host counties' and host municipalities' host aid level.

This is the sponsor's own case for the bill, quoted from their memorandum. It is not Agora's description of what the bill does.
