The sponsor's argument

Why James Skoufis says this is needed

Anesthesia care is a critical component of many medical procedures and should be guided solely by medical necessity, not restricted by arbi- trary time limits imposed by insurers. Time caps on reimbursement not only jeopardize patient safety but also place undue financial burdens on patients and interfere with sound medical judgment. Such limitations hinder healthcare providers from delivering optimal care, increasing the risk of complications, and prolonging recovery. Prohibiting these harmful practices ensures patients receive the care they need, promotes fairness, and safeguards equitable access to essen- tial health services. Last year, an insurer attempted to adopt a policy that would have denied payment for anesthesia services exceeding a predetermined time limit during surgeries or procedures. Given the many valid reasons a procedure might run longer than expected, this policy would have forced patients to pay thousands of dollars out of pocket, potentially resulting in overwhelming medical debt. The American Society of Anesthesiologists condemned the now-rescinded policy, calling it inconsistent with medical standards, billing prac- tices, and a commitment to patient safety. This legislation would ensure that no insurer in New York State can ever again implement such a harm- ful and irresponsible policy.

This is the sponsor's own case for the bill, quoted from their memorandum. It is not Agora's description of what the bill does.
