Summary
This bill would prevent the sale, purchase, and use of software that uses non-public data from competitors in an industry to set rents, fees, vacancies, and other contract terms for dwelling units or commercial premises, or to set prices of other goods or services. It would also prevent the collection of data to determine or recommend these terms or prices and the facilitation of agreements between unrelated parties to set these terms or prices. Violations of the sale, purchase, and use prohibitions would be subject to civil penalties and other enforcement under the new subchapter, while violations of the prohibitions on data collection and facilitation of agreements would be subject to enforcement under the New York City Consumer Protection Law. This bill would also make available a private right of action to enforce the prohibitions.
